General Terms and Conditions of Use of the kareer ® platform for Users
These General Terms and Conditions of Use of the kareer ® platform govern the mutual rights and
obligations between the Users and the Operator of the kareer ® platform arising from the usage of the
kareer ® platform.
Art. 1 Definitions
The following terms used in these General Terms and Conditions of use of the kareer ® platform for
Users will have the meanings set out below, unless it is specifically indicated otherwise:
kareer Platform an online platform operating on the website www.kareer.ai, the
purpose of which is to provide students and university graduates with
job offers.
Operator the company Kareer Cloud s.r.o. with its registered office at Rybná
716/24, Staré Město, 110 00 Praha 1, IČ 06980023, registered with
the Commercial Register kept by the Municipal Court in Prague,
Section C, Insert 292472.
User a job seeker, which has registered a User Account on the kareer
Platform.
User Account a user profile created for the User, by means of which the User logs in
the kareer Platform, in which they enter their data and under which
identity they interact with Customers on the kareerPlatform.
Customer a potential employer, interested in the facilitation of employees, which
has registered a Customer Account on the kareer Platform.
Customer Account a user profile created for the Customer, by means of which the
Customer logs in the kareer Platform, in which they enter their data
and under which identity they interact with Users on the kareer
Platform.
Terms of Use this document, which regulates the conditions of use of the kareer
Platform by Users.
Art. 2 Subject of the kareer Platform
2.1 The primary purpose for operating the kareer Platformis to provide senior students and
university graduates in selected fields with job offers, made by Customers. Related to the
primary purpose, other usesmay also include:
- offering Users further education or qualification,
- providing Users with education guidance,
- testing Users’ (especially soft) skills,
- a community platformfor sharing and exchange of information related to the job
opportunities of university graduates.
2.2 Users, who create a User Account, provide information on their profile regarding their
professional qualifications, other skills and work experience and, where applicable, information
regarding their professional and non-professional interests and expectations regarding their
future employment. Through Customer Accounts, Customers have access to (anonymized or
pseudonymized) parts of the data relating to Users. In the event that the Customer, on the
basis of the available data on qualifications and experience, expresses an interest to access a
User's identification or contact data, he shall send the User a request via the kareer Platform
to make his identification and contact data available. The User can find out the identity of the
Customer, requesting the disclosure of his identification and contact data through the kareer
Platform and then decide whether to consent to the disclosure of his identification and contact
data to the given Customer.
2.3 The kareer Platform also gives the User an opportunity to directly contact a Customer that has
publicly published a job offer on the Platform. During the primary contact the Customer again
does not receive identification and contact data, only other data (on education, qualifications,
work experience and soft skills), however, by making a request the User agrees that the
Operator shall pass on his identification and contact details to the contacted Customer, should
the Customer express an interest.
2.4 For Users, the participation in the kareer Platform is generally free. Provision of related
services could form an exception; however, the User will always be informed of the charge by
the Operator through the user interface of the kareer Platform before ordering such services.
The free participation in the kareer Platform is related to the fact that the User is not legally
entitled to the provision of services by the Operator, nor does he have any (with following
exceptions) claims due to possible malfunction or defective functionality of the kareer Platform.
However, the Operator is in all circumstances obligated to ensure that the Users’ personal
data is properly processed in accordance with the relevant legal regulations governing the
processing of data. In the case of ordering any of the related paid services the provision of
such service will be governed by special conditions, published by the Operator for the
provision of this service and in this case the Operator is fully legally obligated towards the
User within the conditions for the provision of such service.
2.5 The Operator can also announce a temporary or permanent User rewards program. In that
case, the conditions for the provision of rewards are governed by the special conditions
published by the Operator for the rewards program. Unless these special conditions stipulate
otherwise or unless the Operator declares otherwise on its website, the provision of rewards to
the User is only of motivating nature and the User does not gain a legal right to the provision
of rewards.
Art. 3 Registration and activation of the User Account
3.1 Before beginning to use the kareer Platform, the User must set up a User Account. This is
done by filling in the basic identification and contact details on the Operator's website. The
Users are obligated to provide only true and current information about themselves andthe
options to contact them.
3.2 Alongside filling in the data in the web form and before sending the data to the Operator's
server, the User confirms the correctness of the filled in data by checking appropriate boxes
and undertakes to comply with these Terms of Use. Another condition for creating a User
Account is that the User takes into account the Terms for the processing of personal data by
Kareer Cloud s.r.o., by which the Operator and the User are bound when processing personal
data in connection with the operation of the kareer Platform.
3.3 The Operator reserves the right to verify the data entered by the User during registration
before activating the User Account. In particular, the Operator is entitled to contact the User
using the contact details provided by the User. In the case of doubt, the Operator is also
entitled to request suitable proof of the User's identity. In the event of non-cooperation by the
User during the process of verification of the User's identity, the Operator is entitled to delay
the activation of the User's Account until necessary cooperation is provided or the identity is
proven by the User in another suitable manner.
3.4 The Operator is entitled to deny the registration of any new User. It could happen so
particularly in the case, that:
- the User does not meet basic requirements (age, education, selected fields of study),
- the User has substantially violated these Terms of Use,
- the User’s User Account has been cancelled in the past due to a breach ofTerms of Use or
due to of long-term inactivity.
3.5 The User will be notified by the Operator about the activation of his User Account by sending
an email to the primary email address the User provided during registration. The User’s data
will not be accessible to Customers before the notification about the activation is made.
Act. 4 The use of the User’s Account
4.1 After activating the User Account, Users can access their profile by inputting their login details
(username and password) on the kareer Platform website. The Operator may also implement
a multi-phase authentication procedure.
4.2 Users are obligated to maintain the confidentiality and security of their login details and other
authentication methods, used to access to User Account, they are particularly obligated not to
disclose them or make them available to anyone. In the case of loss or disclosure of these
details, Users are obligated to immediately inform the Operator, which will, until confidentiality
is restored, make the User Account inaccessible.
4.3 If Users intend to make effective use of the kareer Platform, it is necessary for them to input
data on their education and qualifications within the application environment, the minimum
scope of which will be indicated by the Operator. Optional data can be filled in according to the
User’s choice. Although thisdata is not necessary for the functioning of the kareer Platform, it
improves the results of the search for a match between the requirements of the Customers
and the expectations of the User.
4.4 Users must be aware of the fact, that if they do not input their full data, or if they subsequently
make their personal data unavailable to such an extent, that it narrows the possibility of
Customers learning the characteristics of a suitable candidate for a given job position, it may
substantially reduce the possibility of finding a match between the Customers' requirements
andthe Users characteristics and may also reduce the frequency of Customers addressing
the Users.
4.5 Under all circumstances, Users are obligated to input only correct data about themselves.
Impersonation or disclosure of information significantly deviating from the facts will always be
considered a significant breach of these Terms of Use.
4.6 Each time Users log in to his User Account, they undertake to either re-verify that all the data
is still current or to mark their User Account as inactive. Users are obligated to log in to his
User Account no later than one year after their last login.
4.7 TheUser’sdata, processed within the kareer Platform, can also include, apart from the data
input bythe User, data originating from the Operator, such as the results of tests performed
during the provision of related services by the Operator. Furthermore, the data on the User
processed within the kareer Platform may also include data coming from Customer feedback.
The User will always be entitled to determine in advance whether this data should also be
accessible to Customers.
Act. 5 Response to Customer requests and the User's primaryinitiative
5.1 The Customers will only have access to the data input by the User within his User Account in
the part, which will be marked by the Operator as accessible to the Customers. In principle,
this data will not include identification and contact data, so from the Customer's point of view,
the User will appear under a pseudonym either chosen by the User or generated by the
Operator.
5.2 If the Customers show interest in gaining access to the User’s identification and/or contact
data, they will send a request to the User through the kareer Platform do so. The Users will
see all these requests within their profile. The Users are informed of the actual identity of the
Customer and the job title. If the Users agree to disclose their identification and contact data
within the time period specified by the Customer, this data will be made available to the
Customer by the Operator. In this case, the Users also agree that the Customer can contact
themwith an offer to participate in the selection process orto directlyfill the job position.
5.3 In the event that the Users directly contact a Customer which has published a job offer in the
kareer Platform environment, the Users shall determine the time period for which their offer is
binding. During the primary contact, the Customer is not given the identification and contact
data of the User, but only other data (on education, qualifications, work experience and soft
skills). If the Customers express an interest, the Operator shall make the identification and
contact data of the User available to them, to which the Users agree when first contacting the
Customer.
Art. 6 The processing of the User’s personal data
The conditions of obtaining, retaining, providing, as well as other ways of processing the User’s
personal data when operating the kareer Platform are governed by a special regulation the Terms
for the processing of personal data by Kareer Cloud s.r.o.
Art. 7 Breach of the Terms of Use
7.1 In the event of a breach of these Terms of Use by the Users,the Operator is entitled to
request the User to remedy the breach and the Users are obligated to, on the basis of this
request, make their conduct compliant with these Terms of Use.
7.2 The following cases will always be considered asa substantial breach of these Terms of Use
from the Users side:
- the User impersonates another person,
- the Users list data on their profile which deviate significantly from reality,
- the Users violate their obligation to update the User Account so it contains only current
data, or their obligation to log in to their User Account within the prescribed time period
since their last login,
- the Users disclose their access credentials to their User Account or other authentication
methods to a third party,
- the Users do not notify the Operator without undue delay of the loss of control over their
access credentials to the User Account or other authentication methods,
- the Users use the kareer Platform in such a way, which is contrary to the purpose of its
operation,
- the Users act towards the Operator or Customers in a manner that raises doubts about the
seriousness of their intentions, or compliance of their conduct with the declared goal of
finding a job (e.g. they repeatedly promise to participate in an interview or selection
process with the Customer and subsequently do not appear).
Art. 8 Cancellation of the User Account
8.1 The Users are entitled to cancel their User account at any time using the kareer Platform web
application environment.
8.2 The Operator is entitled to cancel a User Account:
- in the event of a substantial breach of these Terms of Use by the User and also in the
event that the User, even following a call for remedy from the Operator, fails to remedy a
less serious breach of Terms of Use,
- in the event that the User Account stays marked as inactive by the User for a 3-year
period,
- if the Operator terminates its business activity or cancels operation of the kareer Platform.
8.3 In all cases of the User Account cancellation, the User is not entitled to any compensation.
Act. 9 Amendment of Terms of Use
9.1 The Operator is entitled to amend these Terms of Use. The Operator shall publish a notice of
the amendment of the Terms of Use on its website and send it to the Users to their primary
email addresses at least 14 days before the change takes effect.
9.2 In the event that the Usersdonot agree with the change, they are entitled to cancel their User
Account at any time.
Act. 10 Final provisions
10.1 These Terms of Use, as well as the mutual rights and obligations of the User and the Operator
concerning the operation of the kareer Platform are governed by Czech law.
10.2 All disputes between the User and the Operator arising in connection with the operation of the
kareer Platform will be decided by the relevant Czech courts.
10.3 The User further acknowledges that the Operator has included content and functionalities of
third parties into the application environment of the kareer Platform on its website:
a) Google Maps use of this content and functionalities is governed by the current version
of(1) Google Maps/Google Earth Additional Terms of Service, published on the website
https://maps.google.com/help/terms_maps.htmla (2) Google’s Privacy Policy, published
on the website https://www.google.com/policies/privacy/;
b) Google Analytics use of this content and functionalities is governed by the current
version of Google APIs Terms of Service, published on the website
https://developers.google.com/terms/;
c) Crunchbase use of this content and functionalities is governed by the current version of
Crunchbase’s Terms of Use, published on the website
https://about.crunchbase.com/terms-of-service/.
These General Terms and Conditions for the use of the kareer platformfor Users have been published
and came into effect on 10.10.2019.
